Topic: I-9 Self-Audits: Employer Best Practices
Overview: The Immigration and Nationality Act (“INA”) requires all employers to complete a Form I-9 for every employee hired after November 6, 1986. Immigration and Customs Enforcement (“ICE”) conducts audits of an employer’s Form I-9s by serving the employer with a Notice of Inspection (“NOI”). ICE conducts random audits of businesses of all sizes and in all industries. The number of I-9 audits conducted by ICE has gone up substantially each Fiscal Year for the past few years. For each Form I-9 that has an error, ICE will access a fine of up to $2,292, and, fines can be higher if ICE believes the employer knowingly hired an employee who was not authorized to work in the United States.
While an I-9 Self Audit is not mandated by law, it is employed by organizations as a best practice to help manage I-9 compliance. The purpose is to find I-9s that are incomplete, missing or have unresolved issues. With just 3 days’ notice before an inspection, it is advised companies correct all issues by conducting an internal audit.

He is a member of American Immigration Lawyers Association’s Board of Governors and Vice Chair of the International Bar Association’s Immigration and Nationality Law Committee. He has written seven books on immigration law topics including the new AILA Cookbook. In 1994, he created the first immigration law web site and in 1998 he created the world’s first law blog. Today, he’s creating artificial intelligence-based web applications for immigration lawyers. In 2020, he was awarded the Advocacy Award by the American Immigration Lawyers Association.
In 1994, he created www.visalaw.com, the world’s first immigration law firm website. That same year, he created Siskind’s Immigration Bulletin, the first law firm e-newsletter, a publication still being published every month. He created the first lawyer blog in the United States in 1997. And in 2016, he became one of the first immigration lawyers to develop artificial intelligence-based expert systems to help lawyers and laymen more efficiently deal with immigration matters.
