On August 1, 2023, U.S. Citizenship and Immigration Services (USCIS) will release an updated Form I-9, Employment Eligibility Verification. One of the improvements is a checkbox for employers using E-Verify to indicate remote examination of documents under a DHS-authorized alternative procedure.Â
The Federal Register document allows some employers to examine Form I-9 documents remotely instead of in-person. To qualify, employers must be enrolled in E-Verify, keep copies of the documents, conduct a live video chat with the employee, and create an E-Verify case for new hires.
Features of the revised Form I-9: Â
– Condenses Sections 1 and 2 onto one page. Â
– Can be filled out on tablets and mobile devices. Â
– Separates the Section 1 Preparer/Translator Certification area into a separate supplement. Â
– Moves Section 3, Reverification and Rehire, to a separate supplement. Â
– Updates the Lists of Acceptable Documents page to include receipts and information on extensions. Â
– Reduces the instructions from 15 pages to 8 pages. Â
– Includes a checkbox for employers to indicate remote examination of documentation.Â
The new version of Form I-9 (dated 08/01/23) will be available on uscis.gov from August 1, 2023. Employers can continue using the current version of Form I-9 (dated 10/21/19) until October 31, 2023. However, starting from November 1, 2023, all employers must switch to using the new Form I-9.Â
