The New Form I-9- Essential Information You Need To Know

The new Form I-9 includes updated requirements for employers. Here are the latest changes:  

  • The new Form I-9 became publicly available on August 1, 2023. 
  • Employers must begin using the new Form I-9 by November 1, 2023. 
  • To confirm that you are using the latest version, check for the date “08/01/2023” in the lower left corner of the document. 
  • Employers who continue to use the old Form I-9 after November 1, 2023, may face fines. 
  • The latest version of Form I-9 can be found on the USCIS website. 

 

Important Updates on Form I-9: 

  •  Sections 1 and 2 have been merged into a single sheet. 
  • The formatting has been simplified to facilitate digital downloads. 
  • Sections for Preparer/Translator Certification and Reverification and Rehire have been moved to separate supplement forms. 
  • The phrase “alien authorized to work” has been updated to “non-citizen authorized to work.” 
  • Instructions for the “List of Acceptable Documentation” section have been revised. 
  • A checkbox has been included for employers to indicate that they have examined Form I-9s through E-Verify. 
  • The overall content has been condensed from 15 pages to 8 pages. 
  • Instructions for electronically verifying Form I-9 have also been added. 

 

Verifying Form I-9s Through E-Verify: 

  • Employees will complete the updated I-9 form. 
  • The form should be examined during a live video conference. 
  • Annotate the I-9 by checking the additional information box. 
  • Open a case in E-Verify. 
  • Save copies of all I-9 forms for remote employees. 

 

These updates are designed to streamline the I-9 verification process and ensure compliance with employment eligibility requirements.
