The federal government shutdown has left employers across states unable to use the E-Verify system to screen eligibility of new hires. State officials said there will be no penalty for hiring during the shutdown, but documents should be submitted when it ends.
E-Verify customer support and related services are also closed. The shutdown does not affect the requirement that employers complete the I-9 form within three days after an employee starts work.
U.S. Citizenship and Immigration Services, one of the agencies that administers E-Verify, has given some guidance to employers on how to operate in its absence. That includes suspending the three-day rule for businesses to vet their employees with E-Verify and extending the period during which employees can appeal tentative non-confirmations of their eligibility.
